Taksir v. Vanguard Group, 17-3585
Held that two investors could proceed with their proposed class action lawsuit alleging that an investment services company breached a contract with them by overcharging for commissions. The company moved to dismiss the relevant claims under the Securities Litigation Uniform Standards Act of 1998 (SLUSA). On interlocutory appeal, the Third Circuit held that the SLUSA bar did not apply here, affirming the district court's ruling that the investors' claims could move forward.
