Geness v. Cox, 17-2073

Held that a man with mental retardation who was detained for nearly a decade awaiting trial could amend his civil rights complaint against the Commonwealth of Pennsylvania. Reversing the district court, the Third Circuit held that the man, who was charged with a crime that may not have occurred, was entitled to amend his complaint to reinstitute his due process and Americans with Disabilities Act claims. The panel affirmed dismissal of his Section 1983 claims, however.
