Ricketts v. Attorney General U.S. , 16-3182
Addressed in what circuit an alien should file an appeal of a nationality determination. A man contended that he should not be removed from the U.S. because he was not an alien at all but a U.S. citizen. The question here was where he should file his appeal from a determination that he was an alien. Addressing the jurisdictional question in detail, the Third Circuit held that his appeal belonged in the Second Circuit, because the Third Circuit had transferred the nationality issue to a district court in that circuit.
