Wayne Land and Mineral Group L v. Delaware River Basin Com., 17-1800
Vacated an order that had dismissed plaintiff's complaint where plaintiff sought a declaratory judgment to conduct hydraulic fracturing to obtain natural gas in Pennsylvania without the oversight of defendant. The district court dismissed plaintiffs complaint stating that the defendants had oversight of plaintiffs project, but the Third Circuit found that the definition of project was ambiguous and remanded the case for fact-finding.
