USA v. Welshans, 17-4106

Plaintiff appealed his child pornography conviction on the grounds the prosecution unduly prejudiced the jury with description of his child pornography files and challenged his sentencing for including an obstruction of justice enhancement. The appellate court agreed that the prosecution improperly appealed to the passions of the jury, but that the misconduct did not violate due process. The court agreed with the sentencing argument and reversed and remanded for re-sentencing.
