Affirming a district court denial of attorney fees in a case where a second action was filed against a defendant based upon a claim asserted in a first action to pay the costs incurred in the first action because attorney fees can only be awarded as costs in such a circumstance where a substantive statute under which the lawsuit was filed defined attorney fees as costs.
