Reversing and remanding the District Court's order dismissing the plaintiff's Telephone Consumer Protection Act (TCPA) claim against a gym that sent an unsolicited automated call to her cellphone for lack of subject matter jurisdiction, holding that the plaintiff need not have been charged for the call to trigger the TCPA's protections and that an individualized violation of a statutory right is always an injury sufficient to support a legal action.
