United States Third Circuit

Wharton v. Danberg, 16-1988

In a putative class action brought by a group of inmates who were over-detained, alleging that the Delaware correctional system routinely fails to release inmates in a timely manner, holding them for days or weeks beyond when they should be set free, the district court's grant of summary judgment in favor of defendants is affirmed where there is no genuine dispute of material fact as to deliberate indifference under the Fourteenth Amendment.
