Doe v. Mercy Catholic Med. Ctr., 16-1247

In a private suit brought by a physician working as a medical resident under Title IX of the Education Amendments of 1972, 20 U.S.C. section 1681 et seq., alleging sex discrimination against a hospital defendant, the district court's dismissal of the complaint is: 1) affirmed in part as to dismissal of the Title IX hostile environment claim, where it is time-barred; and 2) reversed in part as to dismissal of the Title IX retaliation and quid pro quo claims where a private retaliation claim exists for employees of federally-funded education programs under Title IX notwithstanding Title VII's concurrent applicability.
