United States Third Circuit

McKernan v. Superintendent Smithfield SCI, 14-4506

A petition for writ of habeas corpus relief from conviction of murder is granted where petitioner's counsel, unlike any competent counsel, failed to recognize the loss of impartiality of the trial judge and, in doing so, deprived petitioner of the effective assistance of counsel that the Constitution guarantees.
