US v. Elonis, 12-3798
On remand from the U.S. Supreme Court, which reversed a conviction of violating 18 U.S.C. section 875(c), which prohibits transmitting in interstate commerce a communication containing a threat to injure the person of another, the conviction is reaffirmed where, although the Supreme Court held that the jury instruction regarding defendant's mental state was insufficient and therefore erroneous, the error was harmless.
