United States Third Circuit
Mack v. Warden Loretto FCI, 14-2738
In a pro se lawsuit brought by a Muslim inmate who claims that he was terminated from his paid work assignment for complaining to a prison official about two correctional officers' anti-Muslim harassment at work, which also caused him to refrain from praying while at work, seeking monetary relief for alleged violations of his rights under the First Amendment, Fifth Amendment, and the Religious Freedom and Restoration Act (RFRA), the District Court's dismissal of all claims is: 1) vacated in part where plaintiff has sufficiently pled a First Amendment retaliation claim and a RFRA claim; and 2) affirmed in part where plaintiff's First Amendment Free Exercise claim and Fifth Amendment equal protection claim must be dismissed.
