United States Third Circuit

US ex rel. Customs Fraud Investigations LLC v. Victaulic Co, 15-2169

In a qui tam action alleging that defendant has, over the past decade, imported millions of pounds of improperly marked pipe fittings without disclosing that the fittings are improperly marked, the District Court’s dismissal of its complaint with prejudice and its denial of plaintiff's subsequent motion for leave to amend its complaint are vacated where the District Court erred in denying plaintiff's motion to amend its complaint on futility grounds.
