Federal Trade Commission v. Penn State Hershey Medical Center, 16-2365
In an administrative complaint filed by the FTC opposing the merger of two large hospitals, alleging that it violates Section 7 of the Clayton Act because it is likely to substantially lessen competition, the District Court's denial of the plaintiffs' motion for preliminary injunction is reversed where, after determining the Government's likelihood of success and weighing the equities, a preliminary injunction would be in the public interest pending the outcome of the FTC's administrative adjudication.
