Goodwin v. Conway, 15-2720

In a 42 U.S.C. section 1983 lawsuit for false imprisonment and malicious prosecution against the three detectives involved in securing plaintiff's arrest warrant for allegedly selling heroin to an undercover police officer, the District Court's denial of defendants' motion for summary judgment and for qualified immunity is reversed where: 1) a booking sheet, which proved plaintiff was incarcerated at the time defendants applied for an arrest warrant, and any inferences derived there from do not preclude a finding of probable cause; and 2) despite the booking sheet, the detectives had probable cause when they applied for plaintiff's arrest warrant, and they are therefore entitled to qualified immunity.
