United States Third Circuit

Nichols v. City of Rehoboth Beach, 15-3979

In a suit brought by a resident, property owner, and taxpayer in the City of Rehoboth Beach, challenging a special election for approval of a $52.5 million bond issue and the resultant issuance of bonds, the District Court's judgment dismissing the case is affirmed where plaintiff has failed to show an illegal use of municipal taxpayer funds, and therefore cannot establish standing on municipal taxpayer grounds.
