United States Third Circuit

In a suit alleging malicious prosecution, false arrest and false prosecution, the District Court's dismissal of the complaint under Fed. Rule 12b(6) is affirmed where all of the claims were properly dismissed in all respects except that the order regarding plaintiff's malicious prosecution claims against defendant are to reflect that these claims are dismissed without prejudice.
