Leonard v. Stemtech Int'l Inc., 15-3198
In a copyright infringement action, arising after defendant, a nutritional supplements company, used plaintiff's photographs of stem cells on its websites and in its promotional and sales materials, the district court's entry of judgment on a $1.6 million jury verdict for plaintiff is affirmed in part and vacated in part where: 1) the district court did not abuse its discretion in denying defendant's motion for a new trial on secondary liability and vicarious liability claims; 2) the jury award was not unconstitutionally or grossly excessive; but 3) the district court's denial of prejudgment interest to plaintiff was in error.
