United States Third Circuit

Brown v. Superintendent Greene SCI, 14-2655

In a habeas corpus action, the district court's denial of the petition is reversed and the case remanded where the trial prosecutor violated Bruton v. US, 391 U.S. 123 (1968), by identifying defendant as 'the other guy' in closing argument for a non-testifying, jointly tried co-defendant's trial after the trial court had redacted information from the co-defendant's confession implicating defendant Brown.
