S.D. v. Haddon Heights Bd. of Ed., 15-1804

In an education action, alleging that defendant school board discriminated and retaliated against plaintiffs for seeking to enforce plaintiff-child's educational rights, the district court's dismissal for lack of subject matter jurisdiction is affirmed where claims of board of education discrimination against a student based on disability are subject to the exhaustion requirements of the Individuals with Disabilities Education Act (IDEA), 20 U.S.C. sections 1400-1482, even where plaintiffs sought to enforce the child's rights under non-IDEA statutes.
