United States Third Circuit

Parkell v. Danberg, 14-1667

In a 42 U.S.C. section 1983 action brought by a Delaware state prisoner who claims that state officials deprived him of his rights under the Fourth, Eighth, and Fourteenth Amendments by subjecting him to unreasonable thrice-daily visual body-cavity searches and harsh conditions and by depriving him of adequate medical care, the District Court's grant of summary judgment to defendants is: 1) reversed in part as only as to plaintiff's claim under the Fourth Amendment for prospective injunctive relief; and 2) otherwise affirmed.
