Deborah Heart & Lung Center v. Virtua Health Inc., 15-2032
In an antitrust suit in involving emergency and non-emergency advanced cardiac interventional procedures, referred to as ACIs, the District Court's judgment in favor of defendant is affirmed where: 1) when a plaintiff offers an undisputed definition of the relevant products (ACIs) and markets at issue, it is just and reasonable to hold the plaintiff to its own definition; and 2) plaintiff set the parameters for the instant dispute before the District Court and subsequently failed to meet its own self-imposed burden.
