Raab v. City of Ocean City NJ, 15-2127

In a 42 U.S.C. section 1988 civil suit against a police officer, the District Court's denial of plaintiff's and defendants' motions for attorney's fees are: 1) reversed in part as to plaintiff's motion where plaintiff can be a 'prevailing party' in such circumstances; and 2) affirmed in part as to defendant's motion, even though the District Court had previously granted summary judgment in the defendant's favor.
