NLRB v. Fedex Freight Inc., 15-2585
In a petition for review of the National Labor Relations Board's certification of a collective-bargaining unit comprised of FedEx drivers at FedEx's South Brunswick Terminal in Monmouth Junction, New Jersey, the NLRB's certification is affirmed over FedEx's challenges where: 1) the NLRB's interpretation of the legal standard to apply in unit-determination cases in Specialty Healthcare and Rehabilitation Center, 357 N.L.R.B. No. 83 (2011), was reasonable; and 2) the NLRB properly applied that standard here.
