Sunday v. Attorney General US, 15-1232

In a Nigerian native's petition for review of the Board of Immigration Appeals (BIA) decision, concluding that the immigration judge (IJ) lacked jurisdiction to consider his request for a waiver of inadmissibility regarding petitioner's U visa application, the BIA decision is affirmed and petition denied where: 1) the Immigration and Nationality Act does not grant the Attorney General the authority to issue petitioner a waiver of inadmissibility; and 2) petitioner's removal does not constitute unconstitutionally disproportionate punishment.
