Cox v. Quinn, 15-6943
In a suit brought by a prisoner who was severely beaten by a fellow inmate while incarcerated at the Western Virginia Regional Jail, alleging that the guards had been deliberately indifferent to a substantial risk to his safety, in violation of 42 U.S.C. section 1983 and the Eighth Amendment, the District Court's denial of summary judgment to defendants is affirmed where they were not entitled to qualified immunity on plaintiff's claims.
