Mazzarella v. Fast Rig Support LLC, 15-3116
In an employer's appeal of a stipulated judgment requiring them to pay plaintiffs overtime, the District Court's judgment is affirmed where the District Court correctly determined that defendants have not met their burden to show that the Motor Carrier Act (MCA) exemption to the overtime provisions in the Fair Labor Standards Act (FLSA) and Pennsylvania Minimum Wage Act (PMWA) applies, 29 U.S.C. section 207(a)(1), 43 Pa. Cons. Stat. Ann. section 333.104(c).
