United States Third Circuit

Gov't of the V.I. v. Mills, 13-4705

Conviction on two counts of first-degree murder is affirmed where the prosecution's repeated suggestions that the jurors could not be safe in their homes if defendant was freed, that defendant's discarded gun could pose a danger to schoolchildren, and the display of photos depicting the victim's corpse during closing argument constituted serious misconduct, but did not rise to the level of a due process violation in light of the overwhelming evidence against defendant and the trial court's curative instructions.
