In an interlocutory appeal of a class action, the district court's denial of defendant's motion to dismiss is affirmed where: 1) Campbell-Ewald Company v. Gomez, 136 S. Ct. 663 (2016), holds that an defendant's unaccepted offer of judgment under F.R.C.P. 68 to the plaintiff in a putative class action does not moot the plaintiff's action; and 2) the circuit's precedent to the contrary has been overruled by Campbell-Ewald.
