US ex rel. Moore & Company, P.A. v. Majestic Blue Fisheries, 14-4292

In an international law action brought under the False Claims Act (FCA) contending that defendants fraudulently obtained licenses from the U.S. to fish tuna under the South Pacific Tuna Treaty, the district court's dismissal under F. R. Civ. Pro Rule 12(b)(1) is reversed where: 1) the FCA's public-disclosure bar is no longer a jurisdictional limitation and 2) the alleged fraud was publicly disclosed but that plaintiff was an original source of information underlying the action.
