Hanover 3201 Realty v. Village Supermarkets, 14-4183

In an antitrust action alleging that defendant supermarket attempted to restrain the market for full-service supermarkets and rental space in Hanover, New Jersey by filing administrative and court challenges to plaintiff's applications for government permits and approvals, the district court's dismissal for lack of antitrust standing is reversed where: 1) plaintiff can establish injury that is inextricably intertwined with defendant's conduct; and 2) defendant is not protected by immunity from antitrust liability for seeking government redress of grievances because its conduct falls within the exception for sham litigation.
