In Re: Google Inc. Cookie Placement Consumer Privacy Litigation, 13-4300

In a class action alleging that defendant internet advertisers developed a method for placing tracking cookies on plaintiffs' web browsers to skirt the cookie blockers of internet browsers, the district court's dismissal of all claims under Federal Rule of Civil Procedure 12(b)(6) is: 1) affirmed is respect to claims under the federal Wiretap Act, 18 U.S.C. section 2510 et seq., the Stored Communications Act, 18 U.S.C. section 2701, and the Computer Fraud and Abuse Act, 18 U.S.C. section 1030; 2) vacated as to claims brought under the California Constitution's privacy right and California tort law; and 3) affirmed as to various other California statute-based claims.
