In re Avandia Marketing, 14-1948
In a class action against GlaxoSmithKline (GSD), brought by health and welfare funds alleging federal RICO claims related to the fraudulent marketing of type II diabetes drug Avandia, the district court's denial of GSD's motion to dismiss is affirmed where plaintiffs have adequately pled concrete injury and proximate cause necessary to establish standing under the civil RICO statute, 18 U.S.C. section 1964(c).
