Leyse v. Bank of Am. Nat'l Ass'n, 14-4073
In a consumer protection action brought under the Telephone Consumer Protection Act of 1991, 42 U.S.C. section 227, the district court's dismissal of the complaint for lack of standing is reversed where: 1) the district court erred in considering defendant's second motion to dismiss, but that error was harmless; and 2) plaintiff as the roommate of the intended recipient of a call has statutory standing to bring suit.
