Nat'l Parks Conservation Ass'n v. EPA, 14-3147
In an environmental action challenging the EPA's approval of Pennsylvania's decision not to require additional pollution controls designed to improve air visibility in national parks and wilderness areas under the Clean Air Act, 42 U.S.C. section 7491, the plaintiff's petition for review is granted in part and denied in part where the EPA's approval was arbitrary in light of the state's flawed best available retrofit technology analysis.
