United States Third Circuit
Bronowicz v. Allegheny County, 13-4497
In a 42 U.S.C. section 1983 case seeking damages for wrongful incarceration after plaintiff's prison sentence was successfully appealed, the district court's dismissal of his claims under Heck v. Humphrey, 512 U.S. 477 (1994), is affirmed in part and reversed in part where an order vacating plaintiff's sentence from the Superior Court of Pennsylvania constitutes a favorable termination of proceedings within the meaning of Heck and does not bar plaintiffs section 1983 claims.
