G.L. v. Ligonier Valley Sch. Dist. Auth., 14-1387
In an interlocutory appeal from an action seeking compensatory education for defendant school district's failure to provide free appropriate public education under the Individuals with Disabilities Education Act (IDEA), the district court's denial of the motion to partially dismiss is affirmed and the statute of limitations for bringing a claim is held to be two years from reasonable discovery of a violation pursuant to 20 U.S.C. section 1415(f)(3)(C), notwithstanding contrary language contained in 20 U.S.C. section 1415(b)(6)(B).
