United States Third Circuit

Washington v. Secretary PA Dep't Corrections, 12-2883

On remand from the US Supreme Court, in a petition for habeas corpus relief from sentence and conviction for murder, the district court's judgment granting relief is affirmed where the Pennsylvania Superior Court unreasonably applied "clearly established Federal law as determined by the Supreme Court," 28 U.S.C. section 2554(d)(1), when it permitted the admission in to evidence of a confession by a non-testifying codefendant that redacted appellee's name and replaced it with the generic terms describing appellee and his role in the charged crimes.
