In a suit brought by a hospital located in an urban area that received a rural wage index designation under Section 401 of the Medicare, Medicare and SCHIP Balanced Budget Refinement Act of 1999, but was unable to obtain further reclassification by the Medicate Geographic Classification Review Board pursuant to the Reclassification Rule, a regulation which prevented hospitals with Section 401 status from receiving additional reclassification by the Board on the basis of that status, the district court's decision upholding the regulation and grant of summary judgment to the government is reversed where Section 401 is unambiguous and therefore the Reclassification Rule is unlawful.
