Convictions and sentences arising from violent assaults at the Independence National Historical Park in Philadelphia are: 1) vacated and remanded for new trial as to defendant Baldwin where the Government's rebuttal submission advocated a basis for conviction that was not charged in the indictment and resulted in a constructive amendment; and 2) vacated as to one of defendant-Santos' assault convictions where it violated the Double Jeopardy Clause.
