Kaymark v. Bank of America, N.A., 14-1816

Plaintiff defaulted on a mortgage held by defendant Bank of America (BOA), and on behalf of BOA, defendant Udren Law Offices (Udren) initiated foreclosure proceedings against plaintiff in state court. The district court's order dismissing the complaint is reversed as to certain Fair Debt Collection Practices Act (FDCPA) claims against Udren but affirmed as to all other claims, where plaintiff has sufficiently pled that certain not-yet-incurred disputed fees constituted actionable misrepresentation under the FDCPA.
