Zirnsak v. Commissioner Social Security, 14-1168

In this case, appellant was involved in a motor vehicle accident in which she sustained head and lung injuries and skeletal fractures. She now seeks Social Security Disability Income (SSRI) benefits. The denial of appellant's claim for SSRI benefits is affirmed, where: 1) the Administrative Law Judge's (ALJ) assessment of appellant's residual functioning capacity (RFC) was supported by substantial evidence; 2) the hypothetical question posed to the vocational expert was not deficient for failure to fully reflect appellant's limitations, as, where a limitation is supported by medical evidence but is opposed by other evidence in the record, the ALJ has discretion to choose whether to include that limitation in the hypothetical; and 3) the existence of minor conflicts between the vocational expert's testimony regarding potential occupations and the Dictionary of Occupational Titles caused appellant no harm and does not warrant remand.
