Kannikal v. Attorney General of the United States, 14-1803

In this employment action, the district court's order dismissing plaintiff's suit against his former employer, the Federal Bureau of Prisons, as untimely based on the six-year statute of limitations set forth in 28 U.S.C. section 2401(a) is vacated and the case is remanded for further proceedings, where: 1) the dismissal cannot stand, as the six-year statute of limitations contained in section 2401(a) does not apply to suits brought under Title VII; 2) plaintiff's suit was therefore timely; and 3) plaintiff did not waive the right to sue.
