Delaware and Hudson Railway Co. v. Knoedler Manufacturers, 13-3678
In this case, plaintiffs settled lawsuits brought by its employees who had suffered injuries as a result of defective train seats, then brought indemnification, contribution, and breach-of-contract claims against defendant seat supplier and defendant repairer. The district court's orders of dismissal are vacated, and the case is remanded for further proceedings, where plaintiffs' state law claims of indemnification, contribution, and breach-of-contract are not preempted by the Locomotive Inspection Act.
