US v. Davenport, 13-3644

In this criminal case, defendant claims that his trial counsel was ineffective when he failed to argue that the Government had breached defendant's plea agreement. Order denying defendant's motion to vacate, set aside, or correct his sentence under 28 U.S.C. section 2255 is affirmed, where, because the Government did not breach the plea agreement, defendant's trial counsel was not ineffective for failing to say there was a breach.
