In this putative class action, plaintiffs allege that defendant charged excessive fees for its services in breach of its fiduciary duty under the Employee Retirement Income Security Act (ERISA). Dismissal is affirmed, where defendant was found not to be a fiduciary with respect to the alleged breaches.
