Mahn v. US Attorney General, 12-4377

Petition for review of the Board of Immigration Appeals' final order of removal is granted and the removal order vacated, where: 1) applying the categorical approach, the least culpable conduct punishable under Pennsylvania's reckless endangerment statute does not implicate moral turpitude; and 2) petitioner's Pennsylvania conviction for reckless endangerment is therefore not a crime involving moral turpitude.
