United States Third Circuit
Blunt v. Lower Merion School District, 11-4200
Order granting a final summary judgment to defendant Lower Merion School District (LMSD) and against all plaintiffs is affirmed, where: 1) there is no evidence showing that LMSD intended to discriminate against plaintiffs, or that LMSD had knowledge of any intentional discrimination on the part of its employees, including deliberate indifference to discriminatory practices; and 2) the court looked at the whole record, including statistical evidence showing that minorities are overrepresented in low achievement classes, to reach its conclusion.
