Hernandez-Cruz v. Attorney General USA, 13-3288

Petition for review of final order of removal is granted and remanded to the Board of Immigration Appeals (BIA) for further proceedings, where plaintiff's conviction for child endangerment does not constitute a crime involving moral turpitude (CIMT), as applying the categorical approach, the least culpable conduct criminalized under Pennsylvania's child endangerment statute, Pa. Cons. Stat. Ann. section 4304(a)(1), is not morally turpitudinous.
