Williams v. BASF Catalysts LLC, 13-1089

In this putative class action alleging that defendants conspired to prevent thousands of asbestos-injury victims from obtaining fair recoveries for their injuries, dismissal of plaintiffs' complaint is: 1) reversed and remanded as to the fraud and fraudulent concealment claims, where the Amended Class Action Complaint properly alleged that defendants lied about an destroyed the asbestos evidence to plaintiffs' detriment; and 2) affirmed as to the New Jersey Racketeer Influenced and Corrupt Organizations Act, where plaintiffs have no plead an injury to their business or property.
